Environmental investigations are required outside of due diligence situations if a land owner / occupier requires an understanding of potential impacts to soil or groundwater.
There are a wide variety of reasons why such information would be required but the process of investigation follows a similar pattern to those conducted during a transaction.
If an environmental issue is identified then it must be addressed by the land owner / occupier. If the issue is suitable for ongoing management then a suitable plan must be developed to satisfy the relevant regulatory body that the associated risk is being adequately controlled. If the issue is sufficiently serious it may be necessary to develop a remedial action plan to mitigate / remove contamination from the site.
